How does ABA Model Rule 1.6(c) actually translate to IT controls?
It requires "reasonable efforts" to prevent inadvertent or unauthorized disclosure. In practice: MFA on every account, encryption at rest and in transit, access controls per matter, immutable audit logs, vendor due diligence, and an incident response plan. We map each one to a measurable control.
We use Clio / MyCase / PracticePanther - do you support that?
Yes. We work with all major practice management platforms. We configure SSO, MFA enforcement, and SCIM provisioning so user lifecycle is automated. We do not resell these - we have no kickback bias.
What about ediscovery and litigation hold?
Microsoft Purview / Google Vault for in-place holds. For matters that require third-party tools (Relativity, Everlaw, Logikcull), we integrate the export pipeline so collections move out cleanly and chain of custody stays intact.
Can you handle a breach if one happens?
Yes. Incident response retainer available; SLA on first callback under 1 hour. We coordinate with breach counsel, your insurer, and state AG notification if required. We have done this; the right move is to have the plan written before the incident, which we include in onboarding.
